1. Purpose and Scope

1.1 This document sets out the terms under which 4 Dimension Kitchens & Bathrooms (“4DKB”, “we”, “our”, “us”) provides a workmanship guarantee for installation and labour services carried out by our employees or approved subcontractors.

1.2 This guarantee applies exclusively to the workmanship of labour and installation services performed by 4DKB and covers defects arising directly from poor workmanship within the meaning of clause 3.

1.3 This guarantee does not extend to design advice, materials, fixtures, appliances, or any third-party works unless expressly stated in writing.

2. Duration and Commencement

2.1 The workmanship guarantee shall remain in effect for twelve (12) months from the date of practical completion of the works.

2.2 “Practical completion” is defined as the date on which the works are reasonably capable of normal use, notwithstanding the existence of minor outstanding or decorative items.

2.3 Where a project comprises multiple stages or distinct areas (for example, separate kitchen and bathroom installations), each stage shall have its own guarantee period commencing upon practical completion of that stage.

3. Activation of Guarantee

3.1 The workmanship guarantee becomes valid only upon:

  • (a) the project being formally signed off by 4DKB as complete or deemed practically complete; and
  • (b) full payment being received by 4DKB for all works, including any agreed variations or additional items.

3.2 Until both conditions in clause 3.1 are met, the guarantee shall remain inactive and unenforceable.

3.3 Sign-off shall be evidenced by either:

  • (a) written confirmation of completion issued by 4DKB; or
  • (b) the date on which the works are deemed practically complete by 4DKB.

4. Extent of Cover

4.1 Subject to the terms herein, 4DKB shall, at its sole discretion, repair, make good, or re-perform any element of the works that is proven to be defective due to poor workmanship within the guarantee period.

4.2 This guarantee covers only the labour element of the works and only to the extent that defects are attributable to workmanship provided by 4DKB or its approved subcontractors.

5. Exclusions

This guarantee expressly excludes:

  • (a) Defects in materials, fixtures, or appliances not supplied by 4DKB.
  • (b) Damage arising from misuse, neglect, lack of maintenance, or failure to follow manufacturer instructions.
  • (c) Normal wear and tear, corrosion, mould, condensation, or other environmental effects.
  • (d) Damage caused by structural movement, ground settlement, or water-pressure fluctuations.
  • (e) Alterations, adjustments, or repairs undertaken by persons not authorised by 4DKB.
  • (f) Purely aesthetic or cosmetic imperfections that do not affect function or safety.
  • (g) Any consequential or indirect losses including, without limitation, loss of use, income, or amenity.

6. Customer Responsibilities

6.1 The customer must maintain the works in a reasonable condition and operate all fittings, fixtures, and systems in accordance with the relevant manufacturer guidance.

6.2 The customer must not permit unauthorised third parties to alter or repair the works. Doing so may render this guarantee null and void.

6.3 The customer must retain all proof of payment, invoices, and correspondence relating to the works as evidence of entitlement under this guarantee.

7. Claims Procedure

7.1 All claims under this guarantee must be made in writing to info@4dkb.co.uk within fourteen (14) days of the defect first becoming apparent.

7.2 The customer must:

  • (a) Provide a clear description of the issue and supporting photographic evidence where possible;
  • (b) Allow 4DKB reasonable access to inspect the works; and
  • (c) Refrain from undertaking any remedial action prior to inspection.

7.3 4DKB will acknowledge receipt of the claim within a reasonable timeframe and, if valid, will arrange for inspection and remedial works within thirty (30) days, subject to scheduling and material availability.

8. Remedies

8.1 Where a claim is accepted, 4DKB will, at its sole discretion, either:

  • (a) repair the defective workmanship; or
  • (b) re-perform the affected works at no additional cost to the customer.

8.2 No monetary refund or alternative compensation shall be payable unless required by law.

8.3 All remedial works shall carry the balance of the original guarantee period only; no extension or new guarantee period will be created.

9. Product and Manufacturer Warranties

9.1 Any products, fixtures, or fittings supplied by 4DKB are covered solely by the respective manufacturer’s warranty.

9.2 4DKB may assist in facilitating manufacturer claims but shall not be liable for any manufacturer defect or failure.

10. Limitation of Liability

10.1 This guarantee applies to workmanship only.

10.2 4DKB’s total liability under this guarantee shall be limited to the reasonable cost of remedying the workmanship defect.

10.3 4DKB shall not be liable for any indirect, consequential, or incidental losses arising from the defect or any delay in rectification.

11. Force Majeure

4DKB shall not be liable for delay or failure to perform its obligations under this guarantee due to circumstances beyond its reasonable control, including but not limited to severe weather, flooding, fire, strikes, pandemics, or supply-chain disruptions.

12. Non-Transferability

This guarantee is personal to the original contracting customer and is non-transferable. It shall automatically terminate if the property is sold or ownership transferred.

13. Statutory Rights

Nothing in this guarantee shall affect the customer’s statutory rights under the Consumer Rights Act 2015 or any other applicable legislation.

14. Governing Law and Jurisdiction

This workmanship guarantee shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with this guarantee shall be subject to the exclusive jurisdiction of the courts of England and Wales.
